Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Kokomo Country Club, an Indiana not-for-profit private club located at 700 E Firmin Street, Kokomo, IN 46901 ("the Club," "we," "our," or "us"). By accessing or using this website and any related services (collectively, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

The Service is an informational and inquiry platform that lets prospective members and guests request tours, ask questions, and learn about Club amenities, events, and membership categories.

Membership at the Club is by application and subject to approval. Submitting an inquiry or scheduling a tour does not create a membership relationship and does not guarantee admission to membership.

Information on the Service is provided for general informational purposes only and does not constitute legal, tax, financial, or professional advice. We make no representation or warranty regarding membership availability, dues, fees, or event scheduling, all of which are subject to change.

You must be at least 18 years old to submit an inquiry. By submitting information, you represent that the information you provide is accurate and that you are authorized to provide it on behalf of yourself or your household.

You agree that information you submit (including contact details, household information, and membership interests) may be shared with Club staff and, where applicable, with the member or partner who referred you. We handle this information consistent with our Privacy Policy.

The Service, including all software, design, text, graphics, logos, and photography, is owned by Kokomo Country Club or its licensors and is protected by U.S. and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access the Service for your own personal evaluation. You may not copy, modify, reverse engineer, scrape, frame, mirror, or create derivative works of the Service without our prior written consent.

You agree not to:

• Submit false, misleading, or fraudulent information;
• Use the Service to violate any law or regulation;
• Interfere with the security or operation of the Service;
• Use automated means to access the Service without our written consent; or
• Resell, sublicense, or commercially exploit the Service or any data obtained from it.

The Service relies on third-party providers (including hosting, analytics, and communications providers). We are not responsible for the acts, omissions, services, or content of any third party.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOKOMO COUNTRY CLUB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Kokomo Country Club and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your information submissions, or your violation of these Terms.

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Howard County, Indiana, and you consent to personal jurisdiction there.

We may update these Terms from time to time. The "Last updated" date above indicates when changes were last made. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
